  1. Introduction
    Welcome to the Indispatch Drivers App ("App"). These Terms of Use ("Terms") govern your use of our App. By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.
  2. Use of the App
    • Eligibility: You must be at least 18 years old and authorized by your transportation company to use the App.
    • License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App solely for your personal use in connection with your employment or contractual relationship with a transportation company.
    • Restrictions: You agree not to:
      • Use the App for any unlawful purpose or in violation of any local, state, national, or international law.
      • Modify, adapt, translate, or reverse engineer any portion of the App.
      • Use the App in a manner that could damage, disable, overburden, or impair our servers or networks.
  3. Account and Security
    • Account Creation: You cannot create or delete an account. Only your employer, a transportation company, can create or delete your account.
    • Account Responsibility: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
    • Security: We implement reasonable security measures to protect your information. However, we cannot guarantee absolute security, and you acknowledge that you use the App at your own risk.
  4. GPS Tracking and Data Use
    • GPS Tracking: The App will request permission to track your location when you start the App or log in. Continuous GPS tracking will operate in the background to update your position in the database.
    • Data Use: Your location data will be used to update the map on the Tracking screen of the Indispatch webapp and to facilitate transportation management. We will not share your location data with third parties except as required by law or as necessary to provide the services.
  5. Privacy Our use of your information is governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
  6. Intellectual Property
    • Ownership: All intellectual property rights in the App and related services are owned by us or our licensors. You do not acquire any ownership rights by using the App.
    • Trademarks: The trademarks, logos, and service marks displayed in the App are our property or the property of other third parties. You are not permitted to use these marks without our prior written consent or the consent of such third party.
  7. Termination
    • Termination by You: You may stop using the App at any time by notifying your transportation company.
    • Termination by Us: We may suspend or terminate your access to the App at any time for any reason, including if you violate these Terms.
    • Effect of Termination: Upon termination, your right to use the App will immediately cease, and we may delete your account and any associated data.
  8. Disclaimers and Limitation of Liability
    • Disclaimer: The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free.
    • Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.
  9. Governing Law These Terms are governed by and construed in accordance with the laws of New Jersey, without regard to its conflict of law principles.
  10. Changes to These Terms We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. You are advised to review these Terms periodically for any changes. Your continued use of the App after the changes become effective constitutes your acceptance of the new Terms.
